Terms & Conditions

These Terms & Conditions apply to purchases of photography products and services from Austin Farrow Photography, including purchases made through our online photo galleries and store. By placing an order, downloading an image, or purchasing a photography product, you agree to these terms.
1. Orders and Payment
All orders must be paid in full at the time of purchase unless otherwise agreed to in writing.
Prices are listed at the time of purchase and may be changed at any time for future orders. Applicable sales tax, shipping charges, and other fees may be added during checkout.
Customers are responsible for reviewing their order carefully before submitting it, including image selections, quantities, sizes, cropping, shipping information, and personalization.
2. Printed Products
Printed photographs and other physical products may be produced by a professional photography lab or other fulfillment partner.
Colors, brightness, cropping, and appearance may vary slightly between digital screens and printed products. These normal variations are not considered defects.
Customers are responsible for reviewing the crop shown during the ordering process. Austin Farrow Photography is not responsible for unintended cropping that was displayed and approved during checkout.
3. Digital Image Purchases
Digital image purchases provide the customer with a personal-use license unless otherwise stated.
Customers may:
- Download and save purchased images.
- Print images for personal use.
- Share images with friends and family.
- Post images on personal social media accounts.
Customers may not:
- Sell or commercially distribute the images.
- Claim the photographs as their own work.
- Remove or alter copyright information when included.
- Use images for advertising, business promotion, merchandise, resale, or other commercial purposes without written permission from Austin Farrow Photography.
- Significantly edit or alter images in a way that misrepresents the photographer's work.
Purchase of a digital image does not transfer copyright ownership.
4. Copyright
All photographs created by Austin Farrow Photography remain the copyrighted property of Austin Farrow Photography unless copyright ownership is specifically transferred through a separate written agreement.
Purchasing a print, digital download, or other photography product does not transfer copyright.
Unauthorized reproduction, resale, commercial use, or distribution of photographs may constitute copyright infringement.
5. Refunds, Returns, and Replacements
Because photographs and photo products are customized or produced specifically for each order, **all sales are generally final**.
Digital downloads are non-refundable once delivered except where required by law.
If a physical product arrives damaged, defective, or was produced incorrectly, please contact Austin Farrow Photography as soon as reasonably possible after receiving the order. Photographs of the damaged or incorrect product may be requested.
When appropriate, Austin Farrow Photography may arrange for a replacement or other reasonable resolution.
Refunds or replacements are generally not available for:
- Customer ordering errors.
- Incorrect image selections.
- Incorrect sizes or quantities selected by the customer.
- Cropping approved during checkout.
- Incorrect shipping information provided by the customer.
- Differences between screen colors and printed colors that fall within normal printing variation.
- Change of mind after an order has entered production.
Nothing in this policy limits any rights that cannot legally be waived under applicable consumer protection laws.
6. Shipping and Delivery
Estimated delivery dates are provided as estimates only and are not guaranteed.
Austin Farrow Photography is not responsible for delays caused by shipping carriers, production laboratories, weather, incorrect addresses, or circumstances outside our reasonable control.
Customers are responsible for providing accurate shipping information.
If an order is returned because an incorrect or incomplete address was provided, additional shipping charges may be required before the order is reshipped.
7. Online Galleries
Photo galleries may only remain available for a limited period.
Customers are encouraged to place orders and download purchased digital images before the gallery expiration date.
Austin Farrow Photography does not guarantee that photographs or galleries will remain stored indefinitely after the stated gallery availability period.
Gallery access information, passwords, or access codes should only be shared with people authorized to view the gallery.
8. Image Availability
Austin Farrow Photography makes reasonable efforts to photograph participants, athletes, students, or other subjects during covered events. However, photography of every individual, moment, pose, or participant cannot be guaranteed unless specifically included in a separate photography agreement.
The presence of a photographer at an event does not guarantee that photographs of every participant will be available for purchase.
9. Image Editing
Images may receive professional editing at the photographer's discretion, including adjustments to exposure, color, contrast, cropping, sharpness, and other visual characteristics.
The photographer retains creative control over the final appearance and editing style of delivered photographs.
Requests for additional retouching or editing may be subject to an additional fee.
10. Reshoots
For scheduled individual or team photography sessions, reshoots are provided at the discretion of Austin Farrow Photography.
A complimentary reshoot may be offered when a significant technical issue caused by the photographer prevents delivery of a usable photograph.
Reshoots are generally not provided solely because of personal preferences involving expressions, hairstyles, clothing, weather, appearance, or other circumstances outside the photographer's control.
11. Schools, Teams, Clubs, and Organizations
When Austin Farrow Photography photographs an event for a school, team, club, tournament, league, or other organization, the organization may assist with scheduling, communication, or gallery distribution.
Unless specifically stated otherwise, purchases made through Austin Farrow Photography are transactions between the customer and Austin Farrow Photography.
The school, team, club, league, venue, or organization is not responsible for fulfilling customer photography orders unless expressly stated.
12. Personal Information
Customer information is used as reasonably necessary to process orders, deliver products, provide customer service, maintain galleries, and operate Austin Farrow Photography.
Orders processed through GotPhoto or another third-party platform may also be subject to that platform's privacy practices, payment processing terms, and other applicable policies.
Austin Farrow Photography does not sell customer personal information for unrelated third-party marketing purposes.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Austin Farrow Photography's liability relating to an individual purchase will not exceed the amount paid by the customer for the affected product or service.
Austin Farrow Photography is not responsible for indirect, incidental, or consequential losses resulting from delayed delivery, gallery availability, lost shipments, technical failures, or circumstances outside our reasonable control.
Nothing in these terms excludes liability that cannot legally be excluded or limited.
14. Events Outside Our Control
Austin Farrow Photography will not be responsible for delays or inability to perform obligations caused by circumstances reasonably outside our control, including severe weather, natural disasters, venue restrictions, illness, equipment failure despite reasonable precautions, internet or hosting outages, laboratory disruptions, shipping carrier delays, or similar events.
15. Chargebacks and Payment Disputes
Customers are encouraged to contact Austin Farrow Photography regarding an order concern before initiating a payment dispute or chargeback.
We will make reasonable efforts to resolve legitimate problems involving an order.
Fraudulent or improper payment disputes may be contested using available order records, delivery information, gallery records, and other documentation.
16. Changes to These Terms
Austin Farrow Photography may update these Terms & Conditions periodically. Changes apply to future purchases from the date the updated terms are posted.
The terms in effect when an order is placed will generally govern that order.
17. Governing Law
These Terms & Conditions are governed by the laws applicable to Austin Farrow Photography's principal place of business, without regard to conflict-of-law principles, except where applicable consumer laws require otherwise.
